BNSS 2023: Chapter V: Section 36

Every police officer while making an arrest shall—
(a) bear an accurate, visible and clear identification of his name which will facilitate easy identification;
(b) prepare a memorandum of arrest which shall be—
(i) attested by at least one witness, who is a member of the family of the person arrested or a respectable member of the locality where the arrest is made;
(ii) countersigned by the person arrested; and
(c) inform the person arrested, unless the memorandum is attested by a member of his family, that he has a right to have a relative or a friend or any other person named by him to be informed of his arrest.

गिरफ्तारी करते समय प्रत्येक पुलिस अधिकारी को -
(ए) अपने नाम की सटीक, दृश्यमान और स्पष्ट पहचान रखनी होगी जिससे पहचान में आसानी होगी;
(बी) गिरफ्तारी का एक ज्ञापन तैयार करें जो होगा-
(i) कम से कम एक गवाह द्वारा सत्यापित, जो गिरफ्तार किए गए व्यक्ति के परिवार का सदस्य हो या उस इलाके का सम्मानित सदस्य हो जहां गिरफ्तारी हुई है बनाया;
(ii) गिरफ्तार व्यक्ति द्वारा प्रतिहस्ताक्षरित; और
(सी) गिरफ्तार किए गए व्यक्ति को सूचित करें, जब तक कि ज्ञापन उसके परिवार के किसी सदस्य द्वारा सत्यापित न किया गया हो, कि उसे अपने किसी रिश्तेदार या दोस्त या उसके द्वारा नामित किसी अन्य व्यक्ति को उसकी गिरफ्तारी के बारे में सूचित करने का अधिकार है।
